General terms and conditions Flamingo Vintage

  1. Applicability
    1.1 These General Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders, and agreements with Flamingo Vintage, to the exclusion of any other general terms and conditions. We will send these Terms and Conditions upon request.
    1.2 Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions.
    1.3 Deviations from the provisions of these Terms and Conditions may only be made in writing, in which case the other provisions will remain in full force.
    1.4 All rights and claims stipulated in these Terms and Conditions and in any subsequent agreements for the benefit of Flamingo Vintage are also stipulated for the benefit of intermediaries and other third parties engaged by Flamingo Vintage. The agreement will only be concluded after Flamingo Vintage accepts your order. Flamingo Vintage is entitled to refuse orders or impose certain conditions on delivery, unless expressly stated otherwise. If an order is not accepted, Flamingo Vintage will notify you within ten (10) business days of receipt of the order.

  2. Prices/Offers
    2.1 All offers from Flamingo Vintage are without obligation and Flamingo Vintage expressly reserves the right to change prices, in particular when this is necessary based on (legal) regulations.
    2.2 All prices are stated in euros and exclude shipping costs and options.
    2.3 Sale items may not be exchanged or returned.
  3. Returns
    3.1 All items can be registered for return by email within the statutory 14-day cooling-off period. You then have another 14 days to submit them for shipping to Flamingo Vintage. Please note that you are responsible for the return costs. In that case, the amount you have already paid will be refunded within 14 days of notification. However, the return must comply with the return policy as described in the return policy.
    3.2 If the product is damaged or damaged beyond what is necessary to test it, we may charge you for the reduction in value of the product. Therefore, please handle the product with care and ensure it is properly packaged when returning it.
    3.3 You are obligated to check whether the items delivered to your home correspond to your order. If this is not the case, you can notify Flamingo Vintage within 7 days by email, clearly explaining why the item is not satisfactory. Flamingo Vintage will refund your payment if it is proven that you do not accept the item for valid reasons.
    3.4 In the exceptional case that you receive an item that does not meet your order, Flamingo Vintage reserves the right to replace the item with an equivalent one, refund the amount paid, or issue an online voucher. In this case, Flamingo Vintage will cover the return shipping costs.
    3.5 If you are returning something on this basis (i.e. not a regular return), please follow these steps:
    Please keep your return shipping receipt, this is your guarantee;
    You will receive the return address from Flamingo Vintage after we have confirmed an incorrect delivery.
    Remove any other old barcodes from the bag/box before shipping;
    Pack the items in such a way that damage is avoided.
    3.6 Refunds will only be made to the original account used to pay for the order.
    3.7 Unstamped returns will not be accepted.
    3.8 We cannot be held liable for too many purchased/paid return labels.
  1. Payments
    4.1 Payments in the webshop can be made via the payment methods offered.
  2. Delivery
    5.1 The delivery times stated by Flamingo Vintage are indicative only. Exceeding the stated delivery time does not entitle you to compensation. However, if the delivery time exceeds 30 days, you are entitled to cancel the order or terminate the agreement to the extent necessary. In that case, Flamingo Vintage will refund any amounts already collected within 30 days.
  3. Retention of title
    6.1 Ownership of delivered products will only be transferred once you have paid everything owed to Flamingo Vintage under any agreement. The risk associated with the products transfers to you upon delivery.
  4. Warranty
    7.1 The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations in force on the date the agreement is concluded.
    7.2 Special Provision for Vintage Clothing: Vintage clothing is secondhand and may contain signs of wear and minor defects due to previous use. Flamingo Vintage will do its best to repair and remedy these as much as possible before offering the products for sale. Defects that fall outside of normal wear and tear and cannot be remedied will be mentioned in the product description. Flamingo Vintage cannot reasonably guarantee that all defects will be fully remedied or identified at the time of sale. The customer's discovery of signs of wear or defects in the clothing upon receipt does not entitle the customer to compensation.
  5. Electronic communications and evidence
    8.1 Flamingo Vintage is not liable for any misunderstandings, mutilations, delays, or improper transmission of data and messages resulting from the use of the Internet or any other means of communication in the traffic between you and Flamingo Vintage (or third parties engaged by you), unless and insofar as there is intent or gross negligence on the part of Flamingo Vintage.
    8.2 Flamingo Vintage's records shall serve as full proof of the existence, content, and performance of the agreement with you in any legal proceedings, until proof to the contrary is provided by the party arguing that the evidence is unreliable.
  6. Force majeur
    9.1 Without prejudice to its other rights, Flamingo Vintage has the right, in the event of force majeure, to suspend the execution of your order or to terminate the agreement without judicial intervention, at its own discretion, by notifying you in writing and without Flamingo Vintage being liable for any damages, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
    9.2 Force majeure means any shortcoming that cannot be attributed to Flamingo Vintage, because it is not its fault and is not its responsibility under the law, legal act or generally accepted views.
  7. Miscellaneous
    10.1 If one or more of the provisions of these Terms and Conditions or any other agreement with Flamingo Vintage are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new, legally permissible, comparable provision to be determined by Flamingo Vintage.
    10.2 Flamingo Vintage is authorized to use third parties in the execution of your order(s).
  8. Complaints
    It's always possible that something doesn't go exactly as planned. We recommend that you first report any complaints to us by emailing info@flamingo-vintage.nl. If this doesn't lead to a solution, you can submit your dispute for mediation through WebwinkelKeur at https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil.
  9. Applicable law and competent court
    1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.
    12.2 All disputes between the parties shall be submitted exclusively to the competent court in the Netherlands.
  10. Intellectual property
    The intellectual property rights to the information on this website and our social media channels belong to Flamingo Vintage. Copying or distributing text, photos, videos, or other materials from this website or our social media channels is prohibited without the express written permission of Flamingo Vintage.
